Section 11 of the Civil Procedure Code (CPC), 1908
states that once a court has decided a matter, the same issue cannot be re-litigated between the same parties.
Example:
Ram files a case against Shyam claiming ownership of a piece of land. The court decides that the land belongs to Shyam. Later, Ram files the same case again about the same land against Shyam.
The court will say: “Res Judicata applies.”
